Arms East LLC – Terms & Conditions of Sale (Canadian Customers)

1. General Overview
Arms East LLC (“we,” “us,” “our”) operates as a licensed firearms and defense products exporter and retailer, serving civilian, commercial, and government clients in the United States, Canada, and approved international jurisdictions. By purchasing from Arms East, you agree to be bound by these Terms & Conditions.
2. Domestic U.S. Sales
2.1 Federal Compliance All firearms sales in the United States are conducted in compliance with applicable federal, state, and local laws. Firearms must be shipped to a licensed FFL holder. The purchaser is responsible for ensuring they meet all eligibility requirements under U.S. law.
2.2 State Restrictions Certain items may not be available for shipment to some U.S. states due to local regulations. It is the buyer’s responsibility to ensure legal compliance with their state and municipality before ordering.
2.3 Order Cancellation & Returns Orders canceled after checkout are subject to a 20% restocking fee. Firearms and ammunition are non-returnable and non-refundable once transferred or shipped. Any accepted return requires prior written approval.
3. Canadian Export Orders
3.1 Under $500 Exemption on Certain Firearm Parts We may utilize the EAR99 under-$500 exemption to legally ship certain firearm parts and accessories directly to Canadian customers without an export license. This exemption:
Limits shipments to 12 per calendar year per customer
Applies to orders under $500 USD
Is only valid for items not listed as ITAR-restricted
3.2 Eligible Items We may export the following under this exemption:
Magazines, stocks, triggers, barrels, iron sights, and rifle receivers (no handguns)
Shotgun receivers
Small parts and accessories
Ammunition reloading components including bullets, brass casings
Reloading equipment including presses, dies, and other tools and components
Optic mounts, bases, and attachments
Grips, bipods, and most all other accessories
We will not ship prohibited items under Canadian law, and we refer all customers to the RCMP Firearms Classification.
3.3 Firearm Orders Shipping Direct to Customer For licensed Canadian dealers, Arms East ships complete firearms under the appropriate Canadian import permit, with transfer occurring in accordance with Canadian law. Dealers must provide:
A copy of their valid Canadian firearms business license
A valid import permit or IIC
Confirmation of end use or resale authorization
Arms East will support all required U.S. export licensing prior to international shipment.
3.4 PAL Verification A valid Possession and Acquisition Licence (PAL) is required to purchase:
Firearms
Ammunition
Magazines
Barrels
Slides
Any component deemed a controlled part under Bill C-21
PAL verification must be submitted before shipment.
3.5 Canadian Taxes (GST Only) All Canadian orders for firearms, optics, ammunition, shipments valued at over $500, and any other item subject to U.S. State or Commerce Department licensing will be cleared on your behalf into Canada and forwarded to you by our Ottawa, Ontario partner office.
Our affiliated Canadian company, Arms East Canada Inc., acts solely as the Importer of Record and logistics forwarding agent. Arms East Canada is not the seller, does not collect payment, and is not a party to the original sale.
The 5% federal GST is paid by Arms East Canada at the time of importation to the Canada Border Services Agency (CBSA). GST may be included in the product price or itemized separately. No HST is charged, regardless of the customer’s province.
Customers acknowledge that they are responsible for any duties or tariffs incurred, and agree to pay these fees prior to release of goods from the Canadian fulfillment centre. At Arms East’s discretion, these fees may be requested prior to export of items from the USA.
3.6 Non-Refundable Policy All Canadian orders are final after checkout. Any cancellation or return is subject to a minimum 20% restocking fee, at our discretion. Items deemed prohibited for import will be refunded less restocking and handling costs.
3.7 Firearms, Optics & Non-Direct Deliverables In the case of items not eligible for direct shipment to Canadian customers — such as complete firearms, rifle scopes, and other controlled optics — Arms East will manage the export from the United States and import into Canada on your behalf.
These items will be:
Exported from the USA in compliance with ITAR, EAR, and applicable export regulations
Imported into Canada on your behalf by Arms East or its Canadian affiliate
Delivered to our fulfillment center in Ottawa, Ontario
Then shipped to your Canadian address via Canada Post or registered courier, depending on the item’s classification and shipping requirements
We ship from the USA to the Canadian office twice per month on the first and third Fridays, ensuring predictable and efficient cross-border service.
This process ensures full compliance with U.S. and Canadian regulations while allowing lawful delivery of controlled goods to licensed Canadian customers with minimal administrative burden.
3.8 EAR99 & Low Value Shipment Exemption (Under $500) Many firearm parts and accessories offered by Arms East are designated as EAR99 under the U.S. Export Administration Regulations (EAR). This classification means the items are not listed on the Commerce Control List (CCL) and not subject to ITAR, but they are still subject to U.S. export controls.
When eligible, these items may be exported under the Low Value Shipment Exemption (15 CFR § 740.9(a)(10)), provided the following conditions are met:
The total shipment value is under $500 USD
The recipient does not exceed 12 LVS shipments per calendar year
The goods are not being re-exported or diverted to embargoed destinations
The items are not subject to a license requirement under Country Group D or E restrictions
Arms East conducts compliance checks and reserves the right to deny shipment if the items, recipient, or destination raise regulatory concerns. Buyers are responsible for ensuring lawful importation into Canada or any other receiving country.
4. International Defense Shipments
4.1 Eligibility We accept international orders from:
Allied government entities
Military procurement programs
Authorized commercial dealers with end-use documentation
4.2 Export Licensing Most military articles (automatic firearms, sound suppressors, thermal and Gen 3+ NVG, certain optics, Level III+ Armor) require:
Completed DSP-83 (ITAR-controlled)
End User Statement (EUS) or government purchase authorization
Compliance with U.S. Department of State and Department of Commerce regulations
We may refuse service to any customer or jurisdiction at our sole discretion for compliance, risk, or political considerations.
4.3 Freight & Delivery All international shipments are securely packaged and shipped via registered air cargo or freight forwarder. Customers may request EXW, DAP, or CIF delivery terms as negotiated.
5. Export Compliance: ITAR / EAR
5.1 Regulatory Jurisdictions Arms East operates under:
The International Traffic in Arms Regulations (ITAR) administered by the U.S. Department of State
The Export Administration Regulations (EAR) under the U.S. Department of Commerce
By purchasing, the customer affirms:
They are not restricted from receiving U.S. export-controlled items
They will not re-export, resell, or misuse items in violation of U.S. or international law
5.2 Prohibited End-Users We do not ship to:
Sanctioned individuals, companies, or countries
Entities or persons flagged by BIS, OFAC, or the U.S. Department of State
Any attempt to misrepresent end-use or destination may result in blacklisting and legal reporting.
6. Indemnity, Use Disclaimer & Jurisdiction
By ordering from Arms East, you agree to:
Acknowledge that Arms East Canada Inc. acts solely as the Importer of Record and logistics agent, and does not assume any responsibility for the end use, possession, or legality of imported items once they are delivered to the customer
Indemnify Arms East LLC and its affiliates against any legal liability arising from improper use or unlawful importation of products
Assume full responsibility for ensuring lawful importation, possession, and use in your country, state, province, or municipality
Agree that Arms East LLC is not liable for any misuse, negligent use, modification, or unintended application of any product sold
Acknowledge that all products must be used in compliance with applicable safety protocols and local laws
Agree that all disputes shall be governed by the laws of the State of Florida, United States, and resolved by binding arbitration
6.1 Mandatory Arbitration Clause
Any claim, dispute, or controversy arising out of or relating to any product sold, shipment, or transaction with Arms East LLC shall be resolved by final and binding arbitration administered by a mutually agreed-upon arbitration service. The arbitration shall be conducted in English in the State of Florida. Each party shall bear its own costs unless otherwise awarded by the arbitrator. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
6.2 Class Action Waiver
By purchasing from Arms East LLC, you waive any right to participate in a class action, class arbitration, or other representative proceeding against Arms East LLC. All disputes must be brought on an individual basis, and not as a plaintiff or class member in any purported class or representative proceeding.
